Artem Sytnyk is enrolled on the corrupted officials list
Glavcom reports, citing the registry data.
The reason for putting Mr Sytnyk is put on the list of corrupt officials due to the decision of the Rivne Court of Appeal of December 13, which upheld the verdict of the court of first instance, which found Artem Sytnik guilty of an administrative offense under part 1 of Art. 172-5 KUoAP ("Violation of statutory restrictions on the receipt of gifts"). An administrative penalty of UAH 3400 was imposed on the NABU Director, and the gifts confiscated for state revenue (Sarny District Court of the Rivne Region calculated that Sytnik had received a gift worth UAH 25 thousand, which exceeds the sum allowed by law).
Following the decision of the appeal, Sytnik's lawyer Vladislav Kicha said his client was up to pay the fine for his vacation in the Rivne region considered an administrative violation by the court.
Recall that on September 6, 2019, the Sarny District Court of the Sumy Region found Artem Sytnyk guilty of violating Part 1 of Art. 172-5 of the Administrative Violations Code and imposed a fine of 3400 UAH with confiscation of gifts.
In court, it has been proven that the NABU Head rented houses twice (December 29, 2018 to January 2, 2019 and March 8 to March 10, 2019) on the Poliske-Sarny hunting farm premises (Rivne region). Officially, he was paid for by a friend of the Poliske-Sarny Ltd. founders, who had been issued a 70% rent discount by the premises administration. Thus, the New Year price for Artem Sytnyk cost UAH 7.000 (full cost - UAH 10.000), and March vacation - UAH 10.500 (instead of UAH 15.000).
Questioned in court, the administrator admitted that the person who had paid the rent did not mention the would-be tenant's name. Later, the woman recognized him - it was the National Anti-Corruption Bureau of Ukraine Director, whom she had previously seen on TV.
The court also questioned a witness who introduced himself as the nephew to the man, who had rented a house for Mr Sytnyk. He said he had known Mr Sytnyk for about three years. He added that he had given the money payed for the rent, back to his uncle.
In turn, the NABU Director said in court he had fully refunded his friend's expenses for renting the holiday homes.
However, the court concluded that Artem Sytnyk violated the Part 2 of Art. 23 of the Law "On the Prevention of Corruption", by receiving a gift whose price exceeds the total value of gifts allowed by law (no more than UAH 1921), and therefore committed an administrative offense related to corruption under Part 1 of Article 172-5 of the Code of Administrative Offenses.
Separately, the prosecutor asked to inflict an additional punishment on the NABU Director in the form of deprivation of the right to occupy positions related to the performance of state functions for one year. However, the district court refused, since it is not provided by the Part 1 of Art. 172-5.
